User Agreement
This agreement outlines the terms and conditions between Delvytech, a company specializing in technology solutions, digital marketing, and adtech services, and its users. By engaging with Delvytech’s services, users agree to adhere to the conditions mentioned herein. “Delvytech” refers to the company providing these services, while “User” denotes individuals or entities utilizing them for personal or business purposes.
Usage Policy
Delvytech is committed to delivering high-quality services, but it is the user’s responsibility to ensure compliance with applicable laws regarding the content used in digital marketing campaigns. We are not liable for copyrighted materials, images, or promotional content provided by clients.
Once services are delivered, clients must review all deliverables, such as websites, marketing content, or designs, within a maximum of 45 days. Any errors or requests for changes after this period will not be entertained. After the termination of services, Delvytech disclaims responsibility for legal or compliance issues related to past projects.
Cognizance of Agreement
By using any service offered by Delvytech, users are deemed to have accepted the terms of this agreement, including updates made from time to time. These updates do not require prior notice, and users are encouraged to review the terms periodically. Delvytech reserves the right to amend this document in alignment with evolving business practices and legal requirements.
Payment Policy
Users are required to pay the fees associated with their chosen services. Payments are securely processed via trusted third-party gateways, ensuring transaction authenticity. While Delvytech endeavors to maintain a seamless payment process, any deficiencies or errors caused by these gateways will be their responsibility. Failure to make timely payments may lead to service suspension, and outstanding dues will be collected as per Delvytech’s payment recovery policies.
User Responsibilities
Users must provide accurate information during onboarding and throughout their engagement with Delvytech. Inaccurate or misleading details may result in service termination or additional investigations. Users are responsible for safeguarding their account credentials, including login IDs and passwords.
Delvytech may assist in recovering lost credentials but is not liable for damages resulting from user negligence. Additionally, users consent to being contacted via email or phone for service updates, feedback, or promotions related to Delvytech’s offerings. If further information is required to comply with regulations or improve services, users are expected to cooperate.
Limitations of Performance
Delvytech provides services such as website development, digital marketing, and ad placements to enhance user visibility and engagement. However, we do not guarantee specific results, such as search engine rankings or lead generation volumes. Delvytech acts as a service provider and is not affiliated with any search engines; as such, we cannot ensure a particular advertisement position or visibility level.
Service performance may also be affected by factors outside our control, including but not limited to internet connectivity issues, changes in government regulations, natural disasters, or technical malfunctions. In the event of service disruptions, Delvytech’s liability is limited to refunding unutilized fees or charges.
Proprietary Rights and Usage Restrictions
All content, data, and materials on Delvytech’s website are the exclusive property of the company. Unauthorized use, copying, or distribution of this material is prohibited and may result in legal action. Services provided are solely for end-users; trading or redistribution of these services without prior approval is strictly forbidden. Users found misusing Delvytech’s services may face account termination, service suspension, or legal proceedings, including claims for damages caused by such actions.
Graphics and Content Policy
Delvytech ensures the creation of visually appealing designs by using publicly available resources or licensed images. However, users must verify that their provided materials comply with copyright laws. Delvytech is not liable for legal disputes or penalties arising from the use of unlicensed images, graphics, or text.
Forfeiture of Digital Assets
In cases of continued non-payment, Delvytech reserves the right to restrict access to the user’s digital properties developed or managed by us. This includes temporarily disabling websites, revoking access to Google Business Profiles, or social media accounts until dues are cleared in full. Clients will receive prior written notice before such actions are taken.
Indemnification
Users agree to indemnify and hold Delvytech harmless against any liabilities, losses, or claims arising from false or misleading representations, unauthorized content, or non-compliance with laws. This includes indemnifying Delvytech for any inconvenience caused by users’ actions or omissions.
Limitation of Liability
Delvytech strives to deliver uninterrupted and secure services, but we are not liable for unforeseeable events such as strikes, blackouts, acts of God, or other external disruptions. Should Delvytech be found deficient in its services, liability is limited to unutilized service fees. We also disclaim liability for damages caused by malware, viruses, or technical faults, despite taking preventive measures to maintain a secure environment.
